This MoldShield Service Agreement (“Agreement”) is entered into by and between BioShield Services, LLC d/b/a MoldShield (“Company”) and the undersigned customer (“Customer”). This Agreement sets forth the terms and conditions under which Company agrees to provide mold protection and remediation coverage for the property described below.

1. Service Description

MoldShield is a preventative mold protection plan designed to prevent against mold and protect your home in the event of mold growth. This Agreement provides coverage for qualifying mold remediation services, subject to the terms and conditions herein.

2. Term and Renewal

  • This Agreement shall have an initial term of one (1) year beginning on the Effective Date.
  • The Agreement will automatically renew for successive one-year terms unless terminated in accordance with Section 9.
  • Customer may not cancel mid-term; cancellation is permitted only upon completion of the initial one-year term.

3. Payment Terms

Customer agrees to pay a monthly subscription fee based on the chosen plan.

  • Subscription fees will be charged automatically via the payment method provided.
  • Failure to make timely payments may result in suspension or cancellation of coverage.

4. Coverage

  • Coverage includes mold inspection, testing, and remediation services up to the following limits: $50,000
  • All remediation shall be performed in accordance with IICRC S500/S520 standards.
  • Coverage applies only to qualifying mold incidents discovered after the Effective Date.
  • Coverage does not apply if customer does not allow or prolongs scheduled quarterly inspections for longer than a 15 day period of scheduled inspection.

5. Customer Responsibilities

Customer agrees to:

  • Maintain the property in a reasonably habitable condition.
  • Promptly address water intrusion issues (e.g., roof leaks, plumbing failures).
  • Permit quarterly MoldShield inspections, including:
  • Moisture testing
  • Air quality testing
  • HVAC filter replacement
  • Follow Company recommendations for preventative maintenance.

Failure to comply with these responsibilities may void coverage.

6. Exclusions

This Agreement does not cover:

  • Pre-existing mold conditions or undisclosed issues prior to enrollment.
  • Damage resulting from Customer negligence, including failure to repair known leaks or water damage.
  • Mold resulting from natural disasters (e.g., hurricanes, floods, fire) that fall under traditional insurance coverage.
  • Cosmetic or aesthetic concerns unrelated to health or structural impact.
  • Damage caused by materials or conditions outside the scope of reasonable remediation standards.

7. Inspections and Service Calls

  • Company will perform quarterly inspections at no additional cost.
  • Service calls outside of scheduled inspections must be requested by Customer and may be subject to a service fee unless covered under this Agreement.
  • Emergency response services are available for active mold events.

8. Limitation of Liability

  • Company’s liability under this Agreement shall not exceed the coverage limits set forth in Section 4.
  • Company shall not be liable for indirect, incidental, or consequential damages.
  • Customer acknowledges that MoldShield is not a substitute for homeowners’ insurance.

9. Cancellation and Termination

  • Customer may cancel this Agreement after one year by providing 30 days written notice.
  • Company may terminate this Agreement for non-payment, fraud, or material breach of Customer’s responsibilities.
  • Upon cancellation or termination, no refunds will be issued for prior payments.

Acceptance

By signing below, Customer acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Agreement. The Parties agree that this Agreement may be executed by electronic means, and any electronic signature (including typed names, digital signatures, or a checkbox selection) shall be the legal equivalent of a manual signature and shall have the same validity and enforceability as a handwritten signature. Each Party agrees to be bound by this Agreement when they execute it electronically.

FAQ

Insurance & Home Warranties

Homeowners insurance ALWAYS excludes mold coverage. A few carriers offer a mold endorsement, but it typically caps at $10,000 and does not cover full remediation. MoldShield fills the gap with proactive prevention and up to $50,000 in protection.

Exclusions (Summary)

  • Pre-existing visible mold prior to activation.
  • Long-term leaks not repaired after notice.
  • Negligence, improper maintenance, or intentional damage.
